Lawyers Stress Obedience to Court Orders
Legal experts have emphasized that all court rulings, including those from the Supreme Court, must be obeyed, even if parties consider them incorrect or unconstitutional. They warned that disregarding such orders undermines the legal system and risks plunging the nation into chaos.
NDC Urged to Comply with Supreme Court Stay on Speaker’s Ruling
Lawyers, including Samson Lardy Anyenini, Managing Partner at A-Partners at Law, and constitutional law lecturers Justice Abdulai and Albert Quashigah from the University of Professional Studies, Accra (UPSA), have advised the NDC Caucus in Parliament to reconsider their stance. They encouraged the NDC to pursue legal remedies to overturn the ruling rather than defy the Supreme Court’s stay of execution on the Speaker’s declaration of vacant seats.
Parliament Resumes Amid Political Tensions
The NDC Caucus has insisted on maintaining what they describe as their “Majority status” in Parliament, despite the Supreme Court’s decision. They argue that parliamentary proceedings “shall not” be questioned by any court. Meanwhile, the governing New Patriotic Party (NPP) celebrates the court’s ruling, which they believe restores their standing.
Legal Experts Call for Constructive Dialogue
With tensions rising ahead of the December elections, the lawyers called on both the NDC and NPP to engage in dialogue to resolve the impasse and prevent further political instability.
Constitutional Democracy and the Role of the Courts
Ace Anan Ankomah, Senior Partner at Bentsi-Enchill, Letsa, and Ankomah, explained that while Parliament enjoys operational autonomy, it remains subject to the Constitution. He noted that the courts generally refrain from interfering in parliamentary affairs unless constitutional violations occur.
Evaluating the Speaker’s Decision: Parliamentary or Constitutional Issue?
Mr. Ankomah argued that the nature of the Speaker’s declaration must be examined—if it involved constitutional interpretation, the court’s orders are binding. Otherwise, the court should exercise restraint.
Respect for Supreme Court Authority
Mr. Anyenini stressed that, regardless of personal reservations, decisions by the highest court must be respected. He urged Parliament to treat the ruling with due regard to maintain the integrity of the country’s legal framework.
