Edudzie Tamakloe, Head of Legal Affairs for the NDC, challenges the Supreme Court’s ruling on vacant parliamentary seats

The Head of Legal Affairs for the National Democratic Congress (NDC), Edudzie Tamakloe, has voiced strong opposition to the Supreme Court’s decision overturning Speaker of Parliament Alban Bagbin’s ruling declaring four parliamentary seats vacant.

On Tuesday, November 12, the court sided with a challenge from Majority Leader Alexander Afenyo-Markin, asserting that Speaker Bagbin’s decision would deny representation to affected constituents.

The court clarified that an MP’s seat is only vacated if they switch political parties within the current term while intending to remain in Parliament under a new affiliation. Articles 97(1)(g) and (h) of the Constitution, the court explained, apply solely to the sitting term, not future ones.

In an interview with Citi News, Tamakloe criticized the ruling, claiming it could lead to dishonesty in politics. “We must not and should not encourage double standards,” he said.

Citing Article 9 of the New Patriotic Party (NPP) constitution, he questioned whether MPs who depart from their party should retain their seats, suggesting the interpretation could allow non-NPP members to represent the party in Parliament.
