Counsel for Speaker Bagbin clarifies the implications of the Supreme Court’s judgment.

Thaddeus Sory, legal counsel for Speaker of Parliament Alban Bagbin, has clarified that the Supreme Court’s recent ruling does not issue any directive or order against the Speaker. This follows the court’s decision to overturn Bagbin’s declaration of four parliamentary seats as vacant.

In its judgment on Thursday, November 14, the Supreme Court stated that an MP could only be deemed to have vacated their seat if they switched political affiliation and continued to serve in Parliament under the new party. The court ruled that Articles 97(1)(g) and (h) of the Constitution apply only to the current term of Parliament and not to future terms or election scenarios.

In a Facebook post, Sory emphasized that the court did not mandate the Speaker to reinstate the affected MPs or recognize their return to Parliament. “There is no order saying that the MPs must be allowed in Parliament or directing that Parliament recognize the said MPs,” he stated, adding, “The order staying execution of the Speaker’s ruling is now spent.”
